This Ordinance may be cited as the Public Utilities (Amendment) Ordinance, 1963.

Clause 2

Amendment of section 2

Section 2 of the Public Utilities Ordinance, 1963 (hereinafter in this Ordinance referred to as the “principal Ordinance”) is hereby amended by deleting the words “and includes any temporary Chairman so appointed” appearing in the second and third lines of the definition of “Chairman” therein.

Amendment of section 5

Subsection (3) of section 5 of the principal Ordinance is hereby deleted and the following substituted therefor: —“(3) The Yang di-Pertuan Negara may appoint any member of the Board to be the Deputy Chairman of the Board, and if for any reason the Chairman is unable to act or the office of Chairman is vacant, the Deputy Chairman may exercise all or any of the powers conferred, or the duties imposed, on the Chairman under this Ordinance.”.

Amendment of section 10

Section 10 of the principal Ordinance is hereby amended —

(a)

by deleting subsection (2) thereof and substituting therefor the following: —“(2) The Chairman, or in his absence, the Deputy Chairman shall preside at meetings of the Board:Provided that if both the Chairman and the Deputy Chairman are absent from any meeting or part thereof, such member as the members of the Board present shall choose, shall preside at such meeting or part thereof.”; and

(b)

by inserting immediately before the word “member” appearing in the second line of subsection (4) thereof the words “Deputy Chairman or other”.

Amendment of section 20

Section 20 of the principal Ordinance is hereby amended —

(a)

by deleting the marginal note thereto and substituting therefor the expression “Protection from personal liability.”;

(b)

by deleting the words “them or any of them” appearing in the seventh and eighth lines of subsection (1) thereof and substituting therefor the words “any such member or employee or any other person acting under the direction of the Board”; and

(c)

by inserting immediately after subsection (2) thereof the following new subsection: —“(3) The Board may make an ex gratia payment out of its funds to any person sustaining any damage by reason of the exercise of any of the powers vested in the Board or its employees under and by virtue of this Ordinance or of any other written law for the time being in force.”.

Clause 6

Amendment of section 30

Subsection (1) of section 30 of the principal Ordinance is hereby amended by deleting the words “other prices by special agreement” appearing in the second line of the proviso thereto and substituting therefor the expression “, by special agreement, other prices which shall be published in the Gazette as soon as may be after the signing of any such special agreement”.
