Regulation 31
Withholding, cancelling, reducing award or compensation
Subregulation 1
Notwithstanding the provisions of these Regulations, where —
the injuries that were received in and which were attributable to service have been caused by or contributed to by gross negligence or misconduct of the deceased member of the 2001 Scheme or 2023 Scheme; or
the member of the 2001 Scheme or 2023 Scheme dies in disgrace or the death is attributable to his misconduct or negligence or due to reasons within his control or resulted from deliberate self-injury or the deliberate aggravation of an accidental injury,the Minister may direct an award officer to withhold, cancel or reduce any award or compensation which may be or has been made under this Part or Part V.
Subregulation 2
The Minister may also direct an award officer to withhold or reduce an award or compensation which may be or has been made under this Part in respect of the disablement of a member of the 2001 Scheme or 2023 Scheme whose service is terminated voluntarily or where the disablement is partly or wholly attributable to the default or negligence of the member or is due to reasons within his control.
