Deferment of payment

Despite any provision in these Regulations, any payment of any moneys under regulation 39 to a relevant person mentioned in regulation 39(1) or a person entitled to apply under regulation 39(3) may be deferred if —
(a)
the relevant person is being investigated for any negligent act or misconduct;
(b)
disciplinary proceedings are being contemplated or have been initiated against the relevant person for any such act of misconduct or negligence; or
(c)
criminal proceedings are being contemplated or have been instituted against the relevant person.
