Amendment of section 77

Section 77 of the Prisons Act is amended —

(a)

by deleting subsection (2) and substituting the following subsection:“(2) No sentence of corporal punishment shall be passed upon —

(a)

a woman;

(b)

a man sentenced by a court to death; or

(c)

a man whom a medical officer considers to be more than 50 years of age.”; and

(b)

by deleting subsection (4) and substituting the following subsections:“(4) No sentence of corporal punishment shall be inflicted unless a medical officer is present and certifies that the prisoner is in a fit state of health to undergo the punishment.(5) If, during the execution of the sentence of corporal punishment, a medical officer certifies that the prisoner is not in a fit state of health to undergo the remainder of the sentence, the corporal punishment shall be finally stopped.”.
