Notification of issue, cancellation, etc., of restriction order
Subregulation 1
A specified officer, or a bank which is subject to a restriction order issued by a specified officer, must notify all the affected persons mentioned in paragraph (4) of the decision of the specified officer to issue, cancel, vary, not to vary, or to extend the restriction order under section 4(1) or 5 of the Act.
Subregulation 2
The notification mentioned in paragraph (1) must be in writing and —
delivered to an affected person personally; or
sent by prepaid registered post addressed to an affected person at the affected person’s last known residential address or registered address,at the following times:
in relation to the decision to issue a restriction order — the date the restriction order takes effect;
in relation to the decision to cancel a restriction order — the date the cancellation takes effect;
in relation to the decision to vary a restriction order — at least one working day before the date the variation takes effect;
in relation to the decision not to vary a restriction order — the date of the decision;
in relation to the decision to extend a restriction order — the date the extension takes effect.
Subregulation 3
If a notification mentioned in paragraph (1) is sent in accordance with paragraph (2)(b), an affected person is deemed to have received the notification 2 working days after the notification is so sent.
Subregulation 4
The affected persons, in relation to a restriction order, are the following:
the scam victim in relation to whom the restriction order is issued under section 4(1) of the Act;
any joint account holder of a bank account of the scam victim maintained by the bank which is subject to the restriction order; (c)any supplementary cardholder of a credit facility of the scam victim granted by the bank which is subject to the restriction order.
Subregulation 5
In this regulation and regulation 7, “working day” means any day other than a Saturday, Sunday or public holiday.
