Penalty

Subregulation 1

Any person who is guilty of an offence under any of the following provisions shall be liable on conviction to a fine not exceeding $10,000 and, in the case of a continuing offence, to a further fine not exceeding $250 for every day or part of the day during which the offence continues after conviction:

(a)

regulation 5(3) in respect of a contravention of regulation 5(1) or (2)(a);

(b)

regulation 8(6) in respect of a contravention of regulation 8(3);

(c)

regulation 11(3) in respect of a contravention of regulation 11(2)(a);

(d)

regulation 14(2), 15(2) or 16(4).

Subregulation 2

Any person who is guilty of an offence under any of the following provisions shall be liable on conviction to a fine not exceeding $10,000:

(a)

regulation 5(3) in respect of a contravention of regulation 5(2)(b);

(b)

regulation 8(6) in respect of a contravention of regulation 8(4) or (5);

(c)

regulation 11(3) in respect of a contravention of regulation 11(2)(b);

(d)

regulation 11(5) or 13(2).
