11A. Restriction on contracting out
Feedback & supportAny term of a contract of service or collective agreement is void insofar as it purports —
contract of service
Defined · s 2
“contract of service” means any agreement, whether in writing or oral, express or implied, whereby one person agrees to employ another as an employee and that other agrees to serve his or her employer as an employee;
(a)
to exclude or limit the operation of any provision of this Act; or
(b)
to preclude any person from making a representation, a claim or an application under this Act.
