45. Saving for defence under Merchant Shipping Act (O. 33, r. 45)

Nothing in Rules 35, 36, 37, 38, 39 and 40 is to be taken as limiting the right of any shipowner or other person to rely by way of defence on any provision of the Merchant Shipping Act which limits the amount of liability in connection with a ship or other property.
