Sale of Goods Act 1979 · 2020 Revised Edition · Part 2 · Formation of the Contract
13. Sale by description
Feedback & supportWhere there is a contract for the sale of goods by description, there is an implied condition that the goods will correspond with the description.
If the sale is by sample as well as by description, it is not sufficient that the bulk of the goods corresponds with the sample if the goods do not also correspond with the description.
bulk
“bulk” means a mass or collection of goods of the same kind which —(a)is contained in a defined space or area; and(b)is such that any goods in the bulk are interchangeable with any other goods therein of the same number or quantity;
A sale of goods is not prevented from being a sale by description by reason only that, being exposed for sale or hire, they are selected by the buyer.
goods
“goods” includes all personal chattels other than things in action and money; and in particular “goods” includes emblements, industrial growing crops, and things attached to or forming part of the land which are agreed to be severed before sale or under the contract of sale and includes an undivided share in goods;
Paragraph 4 of the Schedule applies in relation to a contract made before 18 May 1973.
