Exemption for offer to existing participants

Subdivision (3) of Division 2 of Part 13 of the Act shall not apply to any person who makes an offer of units in a collective investment scheme where —
(a)
the offer is made to any existing participant of the scheme; and
(b)
the units being offered are uniform in all respects with units previously issued to and currently owned by the existing participant.

Subdivision (3) of Division 2 of Part 13 of the Act does not apply to a responsible person of a real estate investment trust who makes an offer of units in the scheme to existing participants of the scheme.
