37B. Securities or securities-based derivatives contracts to which exemptions under section 277(1) of Act do not apply

The following securities or securities-based derivatives contracts are prescribed for the purposes of section 277(1) of the Act:

any instrument conferring or representing a legal or beneficial ownership interest in a partnership or limited liability partnership;
structured notes issued by a specified financial institution;
securities-based derivatives contracts where the obligations under the securities-based derivatives contracts are to be discharged by one party to the other at some future time by cash settlement only.
