Regulation 58

Exercise of right of accused

Subregulation 1

Any right of an accused —

(a)

under these Regulations to call or examine witnesses or to address the court;

(b)

to object to the admissibility of evidence; or

(c)

under regulation 12(1)(c), (3) or (4), 14, 17, 20, 21, 22, 23, 24, 31, 33, 45, 50, 52(3) or 55(2),may be exercised by his defending officer or counsel on his behalf.

Subregulation 2

Any reference in these Regulations to any address, request, application, claim, submission or objection made, taken or offered by an accused shall be construed as including any address, request, application, claim, submission or objection made, taken or offered by his defending officer or counsel on his behalf.

Subregulation 3

An accused who is to be tried before a general court martial shall, not less than 24 hours before his trial, give the registrar for subordinate military courts a written notice stating —

(a)

whether he is to be defended by a defending officer or counsel; and

(b)

if so, the particulars of the defending officer or counsel.
