Regulation 1

Citation and commencement

This Order may be cited as the International Organisations (Immunities and Privileges) (International Monetary Fund) Order 2008 and shall be deemed to have come into operation on 1st January 2008.

In this Order, unless the context otherwise requires —“Deputy Resident Representative” means the Deputy Resident Representative of the Fund in Singapore;“Fund” means the International Monetary Fund;“member of the professional staff”, in relation to the Fund, means —

(a)

the Resident Representative;

(b)

the Deputy Resident Representative; or

(c)

any other officer or employee of the Fund who, for the time being —

(i)

is assigned or appointed by the Fund to the Resident Representative Office; and

(ii)

is designated as such by the Fund in consultation with the Government;“Resident Representative” means the Resident Representative of the Fund in Singapore;“Resident Representative Office” means the Resident Representative Office of the Fund in Singapore.

Regulation 3

Immunities and privileges in addition to those previously conferred

This Order is without prejudice to —

(a)

the Bretton Woods Agreements Order (Cap. 27, O 1); and

(b)

every other written law which sets out the status, immunities and privileges of the Fund, or any of its officers and employees, for the purpose of giving effect to the Articles of Agreement of the Fund.

Status of International Monetary Fund

The International Monetary Fund is an organisation of which the Government and the governments of foreign sovereign Powers are members.

Immunities and privileges of Fund in relation to Resident Representative Office

The Fund shall have, in relation to the Resident Representative Office, the like inviolability of premises as is accorded in respect of the premises of an envoy of a foreign sovereign Power accredited to the Republic of Singapore.

Immunities and privileges of members of professional staff of Fund

Subregulation 1

A member of the professional staff of the Fund shall enjoy immunity from personal arrest or detention and from seizure of his personal baggage, except in so far as in any particular case that immunity is waived by the Fund.

Subregulation 2

A member of the professional staff of the Fund shall enjoy the like exemption or relief from the following taxes as is accorded to an envoy of a foreign sovereign Power accredited to the Republic of Singapore, except in so far as in any particular case any such privilege is waived by the Fund:

(a)

all vehicle taxes (including any additional registration fee and any fee for certificate of entitlement);

(b)

radio and television licence fees;

(c)

subject to sub-paragraphs (3) and (4), customs duties on all dutiable goods; and

(d)

where the member of the professional staff is the Resident Representative, foreign domestic worker levy in respect of one foreign domestic worker employed by him.

Any member of the professional staff of the Fund who imports for his personal use any furniture and effects more than 6 months after he first takes up his appointment in Singapore shall not enjoy the exemption or relief from the tax referred to in sub-paragraph (2)(c) in respect of such furniture and effects.

Where any member of the professional staff of the Fund has enjoyed the exemption or relief from the tax referred to in sub-paragraph (2)(c) in respect of any motor vehicle, he shall not enjoy that exemption or relief in respect of any other motor vehicle imported by him within 4 years from the date on which he imported the first-mentioned motor vehicle.

Notwithstanding anything in this Order, no immunity or privilege referred to in this paragraph shall be enjoyed by any person who is a citizen or permanent resident of Singapore.

Non-application of Part IV of Schedule to Act

Part IV of the Schedule to the Act shall not apply to extend any immunity or privilege conferred by this Order to any person.

Revocation

The International Organisations (Immunities and Privileges) (International Monetary Fund) Order 2005 (G.N. No. S 684/2005) is revoked.
