Regulation 3

Exemption in relation to driving of specified motor cycle

An individual who drives a specified motor cycle during and in connection with a cycling event on a specified road is exempt from section 73 of the Act (insofar as it relates to the requirement that a driver of a two‑wheeled motor cycle must not carry any person otherwise than sitting astride the motor cycle) under the following conditions:

(a)

the individual is authorised by the event organiser to drive the specified motor cycle;

(b)

the individual who drives the specified motor cycle possesses a valid driving licence granted under the Road Traffic (Motor Vehicles, Driving Licences) Rules (R 27) authorising the individual to drive the class of motor vehicles that the specified motor cycle belongs to;

(c)

the individual being carried on the specified motor cycle —

(i)

is in a seated position; and

(ii)

is firmly secured to the specified motor cycle by means of straps to ensure the person’s safety;

(d)

there is in force, at any time the specified motor cycle is driven in connection with the specified event, a policy of insurance in relation to the specified motor cycle insuring against any liability in respect of —

(i)

the death of or bodily injury sustained by any individual (whether or not including the driver or any pillion rider of the specified motor cycle); and

(ii)

any property damage suffered by any person (whether or not including the driver or any pillion rider of the specified motor cycle),caused by or arising out of the use of the specified motor cycle;

(e)

the risk under the policy of insurance mentioned in sub‑paragraph (d) is assumed by an insurer who, at the time the policy is issued, is lawfully carrying on an insurance business in Singapore.
