Citation and commencement
These Rules may be cited as the Road Traffic (Expressways — Excluded Vehicles) Rules 2010 and shall come into operation on 1st November 2010.

In these Rules, unless the context otherwise requires —
Definition
“authorised officer” means an officer authorised by the Authority to administer and enforce these Rules;
Definition
“driver”, in relation to a vehicle, means the person driving or in charge of the vehicle;

“dumper” means an engineering vehicle designed for carrying bulk material with the load skip in front of the driver;

“excluded vehicle” means any of the vehicles specified in the First Schedule;

“grader” means an engineering vehicle which uses a long blade in the precision finishing of road surfaces;

“hydrant dispenser” means an engineering vehicle which is used for the refueling of aircraft or other vehicles through the use of connecting hoses, and which may have an elevating platform;

“owner”, in relation to a vehicle, means —
(a)
each person who is the owner, joint owner or part owner of the vehicle; or
(b)
a person who has the use or control of the vehicle under a credit agreement, hiring agreement, hire-purchase agreement or leasing arrangement,but does not include the driver of a vehicle when the driver has been provided as part of a hiring agreement for the vehicle;

Definition
“wheel loader” means an engineering vehicle that has a front attachment connected to the end of 2 booms which can be used to scoop up material such as but not limited to dirt, sand or gravel, and to move such material from one place to another.
Subregulation 2
Any provision of these Rules containing any prohibition or restriction relating to the driving, moving or stopping of a vehicle, or to its remaining at rest, shall be construed as a provision that no person shall use an expressway by driving, moving or stopping the vehicle or by causing or permitting it to be driven or moved, or to stop or remain at rest, in contravention of that prohibition or restriction.
Regulation 3
Use of expressway by excluded vehicles
Subregulation 1
Except as otherwise provided by these Rules, no person shall use any excluded vehicle, or cause or permit any excluded vehicle to be used, on any part of an expressway.
Subregulation 2
The Authority may, if it thinks fit, grant a permit authorising an excluded vehicle to be used on an expressway —
(a)
for the maintenance, repair, improvement, cleaning or clearance of any part of the expressway;
(b)
for the erection, laying, maintenance, alteration or removal of any structure, works, apparatus or any other thing on, under or over any part of the expressway; or
(c)
for the purpose of enabling the excluded vehicle to cross an expressway or to secure access to any premises abutting on or adjacent to the expressway.
Subregulation 3
Where by reason of any emergency the use of any road (not being an expressway) by any excluded vehicle is rendered impossible or unsuitable, the Authority may —
(a)
grant a permit authorising the excluded vehicle to be used on an expressway or any part thereof as an alternative road for the period during which the use of the road by the excluded vehicle continues to be impossible or unsuitable; and
(b)
relax any prohibition or restriction imposed by these Rules in so far as the Authority considers necessary to do so in connection with the use of the expressway or any part thereof by any excluded vehicle in pursuance of any permit granted under this rule.

Application for permit

Subregulation 1
The owner or driver of an excluded vehicle may apply to the Authority for a permit authorising the excluded vehicle to be used on an expressway or any part thereof.

An application under paragraph (1) shall —
(a)
be made to the Authority —
(i)
in the appropriate form set out on the Authority’s Internet website at https://onemotoring.lta.gov.sg/ or in such other manner as the Authority may allow in any particular case; and
(ii)
not less than 3 working days before the excluded vehicle is used on any expressway; and
(b)
be accompanied by the following:
(i)
an indemnity in the appropriate form set out on the Authority’s Internet website at https://onemotoring.lta.gov.sg/ indemnifying the Authority against any damage to the expressway and all other claims and liabilities in respect of any death, injury, damage or loss which may be suffered by any person by reason of the use of the excluded vehicle on the expressway; and
(ii)
such documents as the Authority may require in support of the application.
Subregulation 3
In granting a permit, the Authority may impose such conditions as it thinks fit relating to —
(a)
the need for police or other escort to be provided when the excluded vehicle is being used on an expressway or any part thereof;
(b)
the hours and route of travel of the excluded vehicle;
(c)
the number of excluded vehicles that may be used on an expressway or any part thereof at any one time; and
(d)
the safety measures that must be taken by the owner or driver of the excluded vehicle when it is being used on an expressway or any part thereof.
Subregulation 4
Any person using an excluded vehicle on an expressway shall, when required by a police officer or an authorised officer, produce for inspection the permit granted by the Authority authorising the excluded vehicle to be used on the expressway or any part thereof.
Subregulation 5
The Authority may, in its discretion, require that any excluded vehicle in respect of which an application for a permit has been made be produced for inspection at an inspection centre or at a location determined by the Authority.
Regulation 5
Refusal to grant or revocation of permit
Subregulation 1
The Authority may refuse to grant a permit to an applicant if the Authority is of the opinion that —
(a)
the applicant is not a fit or proper person to be granted a permit;
(b)
the excluded vehicle in respect of which the application is made is unsuitable for use on any expressway; or
(c)
it is not in the public interest to allow the use of the excluded vehicle in respect of which the application is made on any expressway.
Subregulation 2
The Authority may revoke a permit if —
(a)
the Authority has reason to believe that the grant of the permit had been obtained by fraud or misrepresentation;
(b)
the Authority is of the opinion that the person to whom the permit has been granted is no longer a fit or proper person to be allowed to hold the permit or to use the excluded vehicle on an expressway;
(c)
the Authority is satisfied that there has been a breach of any condition subject to which the permit was granted;
(d)
the Authority has reason to believe that the excluded vehicle has been used for an unlawful purpose or in an unlawful manner; or
(e)
the Authority is of the opinion that it is in the public interest to do so.
Regulation 6
Exceptions
These Rules shall not apply to any excluded vehicle that is used, or authorised to be used, on an expressway by the Authority, the Singapore Police Force, the Singapore Armed Forces or the Singapore Civil Defence Force for the purpose of executing its functions.
Regulation 7
Saving and transitional provision
Subregulation 1
Where a person has, before 1st November 2010, obtained the authorisation of the Deputy Police Commissioner under the revoked rule 11 of the Road Traffic (Expressway Traffic) Rules (R 23) to use an excluded vehicle on an expressway on or after that date, rule 3(1) of these Rules shall not apply to such person or the excluded vehicle in respect of which the authorisation has been granted for so long as the authorisation continues to be valid.
Subregulation 2
In this rule, “revoked” means revoked by the Road Traffic (Expressway Traffic) (Amendment) Rules 2010 (G.N. No. S 649/2010).
