Regulation 5

Refusal to grant or revocation of permit

Subregulation 1

The Authority may refuse to grant a permit to an applicant if the Authority is of the opinion that —

(a)

the applicant is not a fit or proper person to be granted a permit;

(b)

the excluded vehicle in respect of which the application is made is unsuitable for use on any expressway; or

(c)

it is not in the public interest to allow the use of the excluded vehicle in respect of which the application is made on any expressway.

Subregulation 2

The Authority may revoke a permit if —

(a)

the Authority has reason to believe that the grant of the permit had been obtained by fraud or misrepresentation;

(b)

the Authority is of the opinion that the person to whom the permit has been granted is no longer a fit or proper person to be allowed to hold the permit or to use the excluded vehicle on an expressway;

(c)

the Authority is satisfied that there has been a breach of any condition subject to which the permit was granted;

(d)

the Authority has reason to believe that the excluded vehicle has been used for an unlawful purpose or in an unlawful manner; or

(e)

the Authority is of the opinion that it is in the public interest to do so.
