Regulation 33
Countermanding notice of hearing where application under section 71 abated, etc.
Where after notice of the hearing of an application under section 71 has been given but before the hearing commences, the defendant dies or resigns, or the Registrar receives —
(a)
an application for withdrawal;
(b)
a notice of the defendant’s intention not to oppose; or
(c)
a notice of the abatement of the application under section 71 by death,the Registrar shall immediately countermand the notice of hearing in the same manner, as near as may be, as a notice of hearing may be given in rule 18.
