Regulation 33

Requirement for UA basic training

Subregulation 1

Subject to paragraph (2), a person must not act as a UA pilot of an unmanned aircraft that has a total mass exceeding 1.5 kg but not exceeding 7 kg for a recreation purpose or an education purpose unless the person —

(a)

has attained the requisite minimum age; and

(b)

holds a UA basic training certificate, or holds a UA pilot licence that is in force.

Subregulation 2

Despite paragraph (1), a person who has not attained the requisite minimum age may operate an unmanned aircraft that has a total mass exceeding 1.5 kg but not exceeding 7 kg for a recreation purpose or an education purpose under the supervision of another person (called in this Part a supervising pilot) who —

(a)

has attained the requisite minimum age; and

(b)

holds a UA basic training certificate, or holds a UA pilot licence that is in force.

Subregulation 3

A person must not act as a supervising pilot unless the person —

(a)

has attained the requisite minimum age; and

(b)

holds a UA basic training certificate, or holds a UA pilot licence that is in force.

Subregulation 4

A person who contravenes paragraph (1) or (3) shall be guilty of an offence and shall be liable on conviction —

(a)

for a first offence, to a fine not exceeding $50,000 or to imprisonment for a term not exceeding 2 years or to both; and

(b)

for a second or subsequent offence, to a fine not exceeding $100,000 or to imprisonment for a term not exceeding 5 years or to both.

Subregulation 5

In a prosecution for an offence under paragraph (4), it is not necessary for the prosecution to prove that the person charged with the offence intended to commit the offence.
