Regulation 21

Sufficiency of documents and records relating to relevant matters

Subregulation 1

A legal practitioner must take reasonable steps to ensure that the documents and records relating to a relevant matter in which the legal practitioner has acted are sufficient —

(a)

to substantially permit a reconstruction of the relevant matter and of any transaction relating to the relevant matter; and

(b)

if necessary, to provide evidence for the prosecution of an offence relating to the relevant matter.

Subregulation 2

A law practice must take reasonable steps to ensure that the documents and records relating to a relevant matter in which the law practice, or any legal practitioner in the law practice, has acted are sufficient —

(a)

to substantially permit a reconstruction of the relevant matter and of any transaction relating to the relevant matter; and

(b)

if necessary, to provide evidence for the prosecution of an offence relating to the relevant matter.
