Receipt, opening and treatment of tenders
Subregulation 1
A contracting authority must receive, open and treat all tenders under the contracting authority’s procedures that ensure fairness and impartiality of the procurement process and the confidentiality of tenders.
Subregulation 2
A supplier whose tender is received after the expiry of the time limit for the submission of tenders must not be penalised if the delay is caused solely by mishandling on the part of the contracting authority.
Subregulation 3
A contracting authority must ensure that any opportunity given to a supplier to correct errors of form between the opening of tenders and the award of the contract does not result in discrimination against any other supplier participating in the tender.
