Citation and commencement
These Regulations are the Environmental Protection and Management (Greenhouse Gases) Regulations 2022 and come into operation on 1 October 2022.
Greenhouse gases
The Fifth Assessment Report of the Intergovernmental Panel on Climate Change is prescribed for the purposes of paragraph (a) of the definition of “greenhouse gas” in section 40A of the Act, which specifies greenhouse gases under the definition of “Greenhouse gas (GHG)” in each Glossary annexed to contributions to the Fifth Assessment Report by Working Group I, Working Group II and Working Group III, as being the following:
water vapour (H2O);
carbon dioxide (CO2);
nitrous oxide (N2O);
methane (CH4);
ozone (O3);
halocarbons and other chlorine- and bromine‑containing substances dealt with under the Montreal Protocol on Substances that Deplete the Ozone Layer (adopted in Montreal in 1987 and subsequently adjusted and amended in London in 1990, Copenhagen in 1992, Vienna in 1995, Montreal in 1997 and Beijing in 1999);
sulphur hexafluoride (SF6), hydrofluorocarbons and perfluorocarbons.
For the purposes of paragraph (b) of the definition of “greenhouse gas” in section 40A of the Act, a substance mentioned in the first column of the Schedule having the chemical formula mentioned in the second column of that Schedule against that substance, is prescribed as a greenhouse gas.
