Regulation 35

Service of documents

Subregulation 1

Without affecting section 131 of the Act, any document required to be served on the appellant for the purpose of any appeal proceedings under these Regulations may be served in the manner set out in paragraphs (2), (3) and (4).

Subregulation 2

A document required to be served on an individual may be served —

(a)

by giving it to the individual personally;

(b)

by leaving it at, or by sending it by prepaid registered post to, the address for service stated in the individual’s notice of appeal; (c)by affixing a copy of the document in a conspicuous place at the individual’s residential address or business address; or

(d)

by sending it by fax to the fax number last known to the person giving or serving the document as the fax number for the service of documents on the individual.

Subregulation 3

A document required to be served on a partnership (other than a limited liability partnership) may be served —

(a)

by giving it to any partner or other similar officer of the partnership;

(b)

by leaving it at, or by sending it by prepaid registered post to, the address for service stated in the partnership’s notice of appeal; or

(c)

by sending it by fax to the fax number used at the business address of the partnership.

Subregulation 4

A document required to be served on a body corporate (including a limited liability partnership) or an unincorporated association may be served —

(a)

by giving it to the secretary or other similar officer of the body corporate or unincorporated association, or to the manager of the limited liability partnership;

(b)

by leaving it at, or by sending it by prepaid registered post to, the address for service stated in the body corporate’s or unincorporated association’s notice of appeal; or

(c)

by sending it by fax to the fax number used at the registered office or principal office of the body corporate or unincorporated association.

Subregulation 5

Any document required to be served on the Authority for the purpose of any appeal proceedings under these Regulations must be sent to the Authority by email to the email address for service stated in the Authority’s reasons filed under regulation 12(1).

Subregulation 6

Where it appears to the Appeal Advisory Committee that there is a good reason to authorise service by a method not permitted by the Act or these Regulations, the Committee may, on the request of a party or on its own initiative, make an order permitting and specifying an alternative method of service.

Subregulation 7

The Appeal Advisory Committee may dispense with service of a document if the interests of justice so require.

Subregulation 8

In this regulation —

Definition

“business address” means —

(a)

in the case of an individual, the individual’s usual or last known place of business in Singapore; or

(b)

in the case of a partnership (other than a limited liability partnership), the principal or last known place of business in Singapore of the partnership;

Definition

“residential address” means an individual’s usual or last known place of residence in Singapore.
