Compoundable offences

The offences under the following provisions may be compounded by the Board in accordance with section 59(1)(b) of the Act:

(a)

any offence (other than a continuing offence) under section 9(2), 19(2), 24A(1B), 26(6) or (11), 33(2)(a), 34(2), 37(1), 40(3), (6) or (10), 40G(7) or (8), 40H(2), 40O(2), 40P(2), 40Q(6), 45(7), 46(3), 47(1) or (6), 47A(1)(a), 50(1), 51, 55(3)(a) or 57(1) of the Act;

(b)

any offence under regulation 38(1) or 41(1), (1A), (1B) or (2) of the Public Utilities (Reservoirs, Catchment Areas and Waterway) Regulations 2006 (G.N. No. S 401/2006);

(c)

any offence (other than a continuing offence) under regulation 4(4), 6(3), 7(3), 8(3), 9(5), 10(2)(a), 11(2), 12(1), (3) or (4), 13(4), 14(2), 15(3)(a) or (4), 26(4), 27(4), 28(3), 29(3), 30(5), 31(2), 36(5), 39(3), 40(4), 40AA(4), 40AB(3), 40AC(2), 40AD(5), 40AE(6), 40AF(6), 40AG(2), 40AH(2), 40BB(7), 40CA(3), 40D(6), 40E(6), 40G(2), 40GA(7), 40H(5), 40I(2), 40IA(4), 40J(5) or 40K(6) of the Public Utilities (Water Supply) Regulations (Rg 5);

(d)

any offence for which a person is liable by virtue of section 56A of the Act in relation to the following:

(i)

any offence (other than a continuing offence) under section 9(2), 46(3), 47(1), 47A(1)(a), 50(1), 51 or 55(3)(a) of the Act;

(ii)

any offence (other than a continuing offence) under regulation 4(4), 6(3), 7(3), 12(1), (3) or (4), 15(4), 26(4), 27(4), 28(3), 31(2), 36(5), 39(3), 40(4) or 40A(7) of the Public Utilities (Water Supply) Regulations;

(e)

any offence (other than a continuing offence) under regulation 5(3), 8(6), 11(3) or (5), 13(2), 14(2) or 16(4) of the Public Utilities (Protection of Water Pipes Infrastructure) Regulations 2017 (G.N. No. S 337/2017);

(f)

any offence (other than a continuing offence) under regulation 4(6), 6(2) or 8(2) of the Public Utilities (Regulated Works and WSI Design Works) Regulations 2018 (G.N. No. S 163/2018).
