Citation
This Order may be cited as the Singapore Business Federation (Exemption) Order.
Annual exemption
Subject to paragraph 3, any local company or foreign company which satisfies the Council that it did not or does not have any employee during the period specified in the first column of the Schedule shall be exempted from section 5(1) of the Act for the year specified in the second column of the Schedule.
For the purposes of satisfying the Council that it did not or does not have any employee during the period specified in the first column of the Schedule, the local company or foreign company shall submit to the Council —
a declaration by any of its directors in such form as the Council may require stating that it did not or does not have any employee during that period; and
such other documents as the Council may require.
Continuous exemption
Subject to sub-paragraph (2), where —
a local company or foreign company is exempted under paragraph 2(1) from section 5(1) of the Act for 2013 or any year thereafter (referred to as a year of exemption); and
the year of exemption is the third consecutive year for which the local company or foreign company is exempted under paragraph 2(1) from section 5(1) of the Act,the exemption of the local company or foreign company shall, without having to satisfy the Council under paragraph 2, continue until the end of the year in which a person starts employment with the local company or foreign company.
Sub-paragraph (1) shall not apply to a local company or foreign company if, during any period of continuous exemption under sub-paragraph (1) of the company, it employed a person and failed to immediately inform the Council in writing of the date on which the person started that employment.
