This Order may be cited as the Energy Conservation (Exemption for Regulated Lamps) Order 2015 and comes into operation on 1 July 2015.

In this Order —“developer”, in relation to a building, means —

(a)

the person who erects, extends, alters, adds to or repairs the building; or

(b)

the person for whom or on whose behalf the building is erected, extended, altered, added to, or repaired;“developer supply agreement” means an agreement entered into before 1 July 2015 by the developer of a building to purchase a regulated lamp for use in the building;[Deleted by S 749/2017 wef 01/01/2018]“in‑stock regulated lamp” means a regulated lamp imported into Singapore or manufactured in Singapore —

(a)

before 1 July 2015; or

(b)

in respect of which the agreement to import or manufacture the lamp is entered into before 1 July 2015;[Deleted by S 749/2017 wef 01/01/2018]“regulated lamp” means a lamp mentioned in paragraph 2(c) of the Energy Conservation (Prescribed Regulated Goods) Order 2017 (G.N. No. S 747/2017).

Regulation 3

Exemption for developers

Where the developer of a building enters into a developer supply agreement for a regulated lamp, the developer is exempted from section 12 of the Act when the developer supplies the lamp in connection with an agreement to sell the building or any part of the building in the course of the developer’s business.

Any person who supplies a regulated lamp to a developer or any other person in connection with a developer supply agreement is exempted from section 12 of the Act.

Any importer or manufacturer who supplies a regulated lamp to a developer or any other person in connection with a developer supply agreement is exempted from section 12A of the Act.
