Citation and commencement
These Regulations are the Community Disputes Resolution (Retention and Disposal of Instruments and Objects) Regulations 2025 and come into operation on 7 April 2025.
Retention of instruments or objects
Where any instrument or object has been seized or removed under section 13L(7) of the Act, the community relations officer who seized or removed the instrument or object must —
record the location, date and time at which the instrument or object was seized or removed;
consolidate the record mentioned in paragraph (a) together with the records of all other instruments or objects (if any) seized or removed at the same location and date;
cause a copy of the records mentioned in paragraph (a) or (b) (as the case may be) to be given to the owner or occupier of the place of residence from which the instruments or objects were seized or removed; and
cause the instrument or object seized or removed to be kept or stored at a place of safety or any other suitable place determined by the community relations officer.
Disposal of instruments or objects seized or removed
When investigations involving an instrument or object seized or removed under section 13L(7) of the Act have been concluded, or at any other time that the Director‑General thinks appropriate, the instrument or object may be —
returned to the person from whom it was seized or the place from which it was removed; or
destroyed or otherwise disposed of in any manner that the Director‑General thinks fit.
