This Order is the Active Mobility (Three‑Wheeled Pedal Cycles for Public Cleaning — Exemption) Order 2024 and comes into operation on 1 March 2024.

Regulation 2

Definitions

In this Order —“handbrake”, for a specified three‑wheeled pedal cycle, means a braking system that —

(a)

is applied by one or more hand levers affixed to the handlebars of the specified three‑wheeled pedal cycle;

(b)

operates on all or any of the wheels of the specified three‑wheeled pedal cycle; and

(c)

when applied, reduces the speed of the specified three‑wheeled pedal cycle or prevents the specified three‑wheeled pedal cycle from moving;“National Environment Agency” means the National Environment Agency established by section 3 of the National Environment Agency Act 2002;“public cleaning work” means any activity to clean or maintain the cleanliness of any public area, and includes all or any of the following activities in any public area:

(a)

sweeping;

(b)

removal of debris or leaf litter;

(c)

removal of bulky waste;

(d)

picking of litter;

(e)

clearing of a dustbin or other receptacle for refuse;

(f)

de‑silting of drains;“specified purpose” means any of the following purposes:

(a)

to transport any individual or thing in connection with any public cleaning work;

(b)

to carry out any public cleaning work;“specified three‑wheeled pedal cycle” means a vehicle that —

(a)

has 3 wheels;

(b)

is steered by handlebars attached to the front wheel; and

(c)

has pedals,and is specified for use by the National Environment Agency in connection with a specified purpose.

Exemption for riding specified three‑wheeled pedal cycle

Sections 15(1) and 19(1)(c) of the Act do not apply to an individual who rides a specified three‑wheeled pedal cycle (called in this paragraph a rider) on a public path for a specified purpose, under the following conditions:

(a)

the rider is —

(i)

employed or contracted by the National Environment Agency to perform the specified purpose; or

(ii)

authorised by the National Environment Agency to ride the specified three‑wheeled pedal cycle;

(b)

the rider, when using the specified three‑wheeled pedal cycle, gives way to other users of the public path;

(c)

the specified three‑wheeled pedal cycle —

(i)

has a width not exceeding 1,300 millimetres;

(ii)

has a length not exceeding 2,600 millimetres;

(iii)

is equipped with a working handbrake; and

(iv)

is built to be propelled solely by human power;

(d)

there is in force, at any time the specified three‑wheeled pedal cycle is used for the specified purpose, a policy of insurance in relation to the specified three‑wheeled pedal cycle insuring against any liability in respect of —

(i)

the death of or bodily injury sustained by any person (whether or not including the rider); and

(ii)

any property damage suffered by any person (whether or not including the rider),caused by or arising out of the use of the specified three‑wheeled pedal cycle;

(e)

the risk under the policy of insurance mentioned in sub‑paragraph (d) is assumed by an insurer who, at the time the policy is issued, is lawfully carrying on an insurance business in Singapore.
