This Order is the Infrastructure Protection (Automated Inventory Update and Inspection of Trees — Exemption) Order 2023 and comes into operation on 13 December 2023.

In this Order —“contractor” means a person under a contract for service for the conduct of a specified inspection;“green verge” and “tree” have the meanings given by section 2 of the Parks and Trees Act 2005;“National Parks Board” means the National Parks Board established by the repealed National Parks Act (Cap. 198A, 1991 Revised Edition) in force before 1 July 1996 and continued by section 3 of the National Parks Board Act 1996;“specified inspection” means the automated inventory update of, or automated inspection of, trees within any green verge;“sub-contractor” means a person under a contract for service with another contractor for the conduct of a specified inspection.

Exemption from taking photograph of protected area or protected place

Subregulation 1

Section 29(1) of the Act does not apply to a contractor (A) appointed or engaged by the National Parks Board to conduct a specified inspection, or any of the following persons acting on A’s behalf for the conduct of the specified inspection, if the specified inspection is conducted under all of the conditions specified in sub‑paragraph (2):

(a)

an employee of A;

(b)

a sub-contractor of A;

(c)

an employee of a sub-contractor of A.

For the purposes of sub-paragraph (1), the conditions specified are as follows:

(a)

A, A’s employee, A’s sub-contractor or the employee of A’s sub‑contractor, acts in accordance with any direction of the National Parks Board relating to the taking of any photograph of a protected area or protected place;

(b)

the taking of any photograph of a protected area or protected place is conducted using equipment mounted on a vehicle;

(c)

the taking of any photograph of a protected area or protected place is solely for the purposes of the specified inspection.
