Notice of application to Court, etc., under section 340(1) of Act
Subregulation 1
The trustee of a bankrupt’s estate on whom an application under section 340(1) of the Act is served must, within 14 days after the date of such service, file in court an explanation of the basis for making the determination which is the subject of the application.
Subregulation 2
The explanation mentioned in paragraph (1) must be in the form of a report.
Subregulation 3
The notice of the application mentioned in section 340(4) of the Act must be in Form PIR‑19.
Subregulation 4
The trustee of a bankrupt’s estate whose determination under section 339 of the Act is the subject of an application under section 340(1) of the Act must, upon the request of any person given notice of the application, provide to that person a copy of any one or more of the following as may be requested:
the application;
the affidavit supporting the application;
the explanation mentioned in paragraph (1).
Subregulation 5
The notice of a variation order which is required to be served under section 340(8) of the Act —
must be in Form PIR-20; and
must be accompanied by a copy of the variation order.
