Section 226 — offence if notice not given
Subregulation 1
Subject to paragraph (2), an authorised officer of a public collection commits an offence if he or she fails to give the notice required under section 226(2)(g)(i) when communicating an electronic copy under that section.
Subregulation 2
It is a defence for the authorised officer to prove that he or she took all reasonable steps to give the notice required under section 226(2)(g)(i).
Subregulation 3
A person convicted of an offence under paragraph (1) shall be liable on conviction to a fine not exceeding $1,000.
