Cases before Tribunal after determination of question of law by Court
Subregulation 1
Where a question of law arising in a case has been referred to, and decided by, the Court under section 494, any party to the case before the Court may file a copy of the order of the Court.
Subregulation 2
Subject to paragraph (3), when a copy of the order of the Court has been filed under paragraph (1), the presiding member must fix a time and place for the resumption of the hearing of the case and the secretary must cause a notice of that time and place to be served on the parties to the case.
Subregulation 3
Paragraph (2) does not apply where the question of law was referred to the Court after the Tribunal had given its decision in the case and that decision is consistent with the opinion of the Court.
