Information under section 79(2) of Act
Subregulation 1
For the purposes of section 79(2) of the Act, the certificate of restructuring of share capital must specify the following information:
either or both of the following, as may be applicable:
the amount by which the share capital of the pertinent financial institution is to be reduced, and the number of shares of the pertinent financial institution that are to be cancelled;
the names of the subscribers (if any) to whom shares are to be issued by the pertinent financial institution, and the number of shares to be issued to each subscriber;
the details of the determination made by the Authority under section 78 of the Act.
Subregulation 2
In this regulation, “subscriber” has the meaning given by section 77 of the Act.
