Regulation 19

Evidence from seafarers

Subregulation 1

Without affecting section 28 of the Act, an investigator when investigating a marine casualty or marine incident under the Act must take into account the provisions of the IMO guidelines on the fair treatment of seafarers.

Subregulation 2

In paragraph (1), “seafarer” means an individual who is employed or engaged or works in any capacity on board a ship, but does not include any of the following:

(a)

a pilot;

(b)

a port worker;

(c)

an individual temporarily employed on the ship during the period it is in port; (d)any other individual who is not a seaman for the purposes of the Merchant Shipping (Maritime Labour Convention) Act 2014.
