These Regulations may be cited as the Workplace Safety and Health (Transitional Provision) Regulations.

Subregulation 1

Notwithstanding the repeal of the Factories Act (Cap. 104, 1998 Ed.) —

(a)

section 86 of that Act shall continue to apply to —

(i)

any charge, information, complaint or other proceeding arising under that Act or any subsidiary legislation made thereunder which relates to any matter which has taken place before 1st March 2006; and

(ii)

any offence under that Act or any subsidiary legislation made thereunder which is committed before 1st March 2006;

(b)

sections 88, 89, 90 and 92 to 99 of that Act shall continue to apply to any contravention of that Act or any subsidiary legislation made thereunder which took place before 1st March 2006; and

(c)

section 91 of that Act shall continue to apply in respect of any act referred to therein which took place before 1st March 2006.

Subregulation 2

Suggest a correction

For the purposes of such application —

(a)

any reference in those provisions to an inspector shall be construed as a reference to an inspector under the Act; and

(b)

any reference in those provisions to the Chief Inspector shall be construed as a reference to the Commissioner under the Act.
