No motor cars, etc., on shared paths
(1)
Subject to this Act, an individual must not drive or ride on a shared path any motor vehicle that is not a PAB, personal mobility device, motorised wheelchair or mobility scooter.
(2)
Subsection (1) does not apply to an individual who is driving a mechanised sweeper on a shared path in the course of his or her employment, which is to sweep or otherwise clean sidewalks or paths.
(3)
An individual who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction —
to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 3 months or to both; but(b)where the individual is a repeat offender, to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 6 months or to both.
