Amendment of section 73A

In the SD Act, in section 73A(1) —

(a)

replace paragraph (c) with —“(c)the particular person has undertaken safeguards to mitigate either or both of the following (as may be appropriate):

(i)

risks to health and safety;

(ii)

risks of flooding (but not any flooding which the Board assesses is permissible);”;

(b)

in paragraph (e), replace the full‑stop at the end with a semi‑colon; and

(c)

after paragraph (e), insert —“(f)it would not be against the public interest to grant the exemption to the particular person.”.
