Section 20

Appeal to Minister

(1)

Any person who is aggrieved by any of the following decisions of an authorised officer may, within 14 days after the date on which notice of the decision is served on the person, appeal to the Minister:

(a)

the refusal to give written approval under section 10(1), 12(1) or 13(1);

(b)

an order under section 10(2), 11(2) or 12(5);

(c)

the imposition of any condition of written approval under section 12(2) or 13(3).

(2)

Despite any appeal made under subsection (1), the order or decision appealed against takes effect and must be complied with unless otherwise ordered by the Minister.

(3)

The Minister may, after considering the appeal, dismiss or allow the appeal, unconditionally or subject to such conditions as the Minister thinks fit.

(4)

The Minister may, in considering an appeal under this section, give the appellant an opportunity to make representations in writing.

(5)

The decision of the Minister in any appeal is final.
