12. Mediation to be voluntary

Attendance at and participation in a mediation session is voluntary.
mediation session
“mediation session” means a meeting in accordance with this Act between 2 or more parties who are in dispute on any matter;
A party to a mediation session may withdraw from the mediation session at any time.
Subsections (1) and (2) do not apply to a mediation session that takes place because of a referral under any of the following provisions:
section 15;
section 13M or 30 of the Community Disputes Resolution Act 2015;
section 18A of the Small Claims Tribunals Act 1984.
Attendance at, participation in or withdrawal from, a mediation session conducted under this Act does not affect any rights or remedies that a party to a dispute has apart from this Act.
