Amendment of section 138

Section 138 of the Companies Act is amended —

(a)

by deleting the words “a copy of every” in subsection (1) and substituting the word “the”;

(b)

by inserting, immediately after the word “Division” in subsection (1), the words “or a copy thereof”;

(c)

by deleting the words “The copies of instruments” in subsection (3) and substituting the words “The instruments or copies thereof”; and

(d)

by inserting, immediately after subsection (3), the following subsection:“(3A) Any person may, on application to a company and on payment of a fee, not exceeding one dollar for every page or part thereof, be furnished with a copy of any instrument or debenture kept by the company in pursuance of this section within 3 days of his making the application.”.
