307. Measure of damages
Feedback & supportThe Court may order additional damages for a rights infringement if it is appropriate in the circumstances, having regard to all relevant matters, including —
(a)
the flagrancy of the infringement; and

“infringement” means an infringement of copyright for which the copyright owner and the exclusive licensee of the copyright have concurrent rights of action;
(b)
any benefit gained by the defendant because of the infringement.
