Section 444

Commercial dealings, etc., in infringing copies

(1)

A person commits an offence if —

(a)

at any time when copyright subsists in a work, the person does any of the following acts:

(i)

makes an article for sale or hire;

(ii)

deals commercially in an article;

(iii)

imports an article for the purpose of commercial dealing;

(iv)

possesses an article for the purpose of commercial dealing; and

(b)

when doing the act, the person knows or ought reasonably to know that the article is an infringing copy of the work.

(2)

A person commits an offence if —

(a)

at any time during the protection period of a performance, the person does any of the following acts:

(i)

makes an article for sale or hire;

(ii)

deals commercially in an article;

(iii)

imports an article for the purpose of commercial dealing;

(iv)

possesses an article for the purpose of commercial dealing; and

(b)

when doing the act, the person knows or ought reasonably to know that the article is an infringing copy of the performance.
