38. Variation of production order

Where a court makes a production order requiring a person to produce any material to any authorised officer, the person may apply to the court for a variation of the order.

“material” includes any book, document or other record in any form, and any container or article relating thereto;

If the court is satisfied that the material is essential to the business activities of the person, the court may vary the production order mentioned in subsection (1) so that it requires the person to make the material available to an authorised officer for inspection.[32
