42. Regulatory action can continue despite licence expiry, etc.

If proceedings under section 39(1), (2) or (3) or 40(2) or (3) are pending against a licensee at the time of the revocation, surrender or expiry of the licensee’s licence, then, despite the revocation, surrender or expiry of the licence, those proceedings may continue and the Authority may exercise any powers under section 39(2)(d) or (3) or 40(2) or (3) (as the case may be) in relation to the former licensee as if the former licensee were a licensee.
