Economic Development Board (Amendment) Bill

by deleting subsection (1) thereof and substituting therefor the following: —“(1) The Board shall consist of —

the Chairman of the Board appointed under section 4 of this Act;

the Director of the Board appointed under section 7 of this Act; and

not less than four and not more than ten other members who shall be appointed by the Minister.”;

by deleting subsection (5) thereof and substituting therefor the following: —“(5) The Minister may appoint not more than two members of the Board to be Deputy Chairmen of the Board.”; and

by inserting immediately after subsection (5) thereof the following subsections: —“(5A) At any time when the Chairman is absent or otherwise incapable of acting, or there is a vacancy in the office of Chairman —

such one of the Deputy Chairmen as the Minister may direct, or in default of any such direction such one of them as they may agree; or

if there is only one Deputy Chairman, that Deputy Chairman,may exercise any of the functions of the Chairman.(5B) At any time when every person who is Chairman or Deputy Chairman is absent or otherwise incapable of acting, or there is no such person, such member of the Board as the Minister may direct, or in default of any such direction such member as the Board may agree, may perform any of the functions of the Chairman.”.

The fixing of the common seal of the Board shall be authenticated by the signature of —

the Chairman or a Deputy Chairman; and

an officer of the Board authorised by the Board, either generally or specially, to act for that purpose.(2) Any document purporting to be a document duly executed under the seal of the Board shall be admissible in evidence and shall, unless the contrary is proved, be deemed to be a document so executed.”.
