Section 76

Notices and penalty for non-compliance

(1)

Any notice issued by the Commissioner in pursuance of any section in this Part shall be complied with within 21 days of the date thereof unless extension of the period has been granted by the Commissioner.

(2)

Any person who fails or neglects to comply with any such notice within the period specified therein including any extension thereof, shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $1,000 and to a further fine not exceeding $50 for every day during which the offence continues after conviction, and a Magistrate’s Court may, on the application of the Commissioner, make a mandatory order requiring such person to construct such sanitary conveniences as the Court thinks fit.

Where any person who has been served with any such notice fails to comply therewith, the Commissioner may, in his discretion, without prejudice to any proceedings under subsection (2) and whether before or after the commencement or conclusion of such proceedings, carry out such works as are specified in the notice and recover from such person the costs and expenses thereof in the manner provided in section 121.

(4)

Nothing in this section shall be deemed to prohibit the Commissioner from carrying out any works specified in any such notice at the request of a person who has been served with the notice upon an undertaking by that person to pay the costs and expenses incurred in executing the works.[78
