False or misleading advertisement
(1)
A person must not advertise any health product or cause any health product to be advertised in a false or misleading way.
(2)
For the purposes of subsection (1), an advertisement of a health product is taken to be false or misleading if —
it falsely describes the health product or gives any false information concerning the health product; or
it is likely to create an erroneous impression regarding the formulation, composition, design specification, quality, safety, efficacy or uses of the health product.
(3)
Any person who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $20,000 or to imprisonment for a term not exceeding 12 months or to both.
