Short title
This Act may be cited as the Misuse of Drugs (Amendment) Act, 1979.

Short title
This Act may be cited as the Misuse of Drugs (Amendment) Act, 1979.
Amendment of section 33
Section 33 of the Misuse of Drugs Act, 1973 (hereinafter in this Act referred to as the principal Act) is amended —
by deleting the word “subsection” in the third line of subsection (2A) thereof and substituting therefor the words “subsection (1) or”; and
by deleting the word “two” in the fourth line of the proviso to subsection (6) thereof and substituting therefor the word “three”.
Amendment of section 33C
Section 33C of the principal Act is amended by inserting, immediately after subsection (3) thereof, the following subsection: —“(4) On proof to his satisfaction that the presence at any place of an inmate is required in the interests of justice, or for the purpose of any inquiry, or in the public interest or in the interest of the inmate, the Superintendent may order that the inmate be taken to that place.”.
New section 33E
The principal Act is amended by inserting, immediately after section 33D thereof, the following section: —“Inmates deemed to be in legal custody33E.—
Every inmate shall be deemed to be in the legal custody of the approved institution in which he is for the time being detained.(2) An inmate shall be deemed to be in legal custody —
while he is confined in, or is being taken to or from, an approved institution; or
while he is for any other reason outside an approved institution in the custody or under the control of an officer of the approved institution; or
while he is being taken to any place to which he is required or authorised by or under this Act to be taken, or is kept in custody in pursuance of any such requirement or authorisation.”.
Amendment of section 34
Section 34 of the principal Act is amended by inserting, immediately after the word “inmates” in paragraph (o) of subsection (1) thereof, the words “and for the granting of leave to inmates for the purpose of their employment outside an approved institution”.
