28. Composition of offences
Feedback & supportAn Executive Secretary or any officer authorised by an Executive Secretary may compound any offence under this Act which is prescribed as a compoundable offence by collecting from a person reasonably suspected of having committed the offence a sum not exceeding the lower of the following:
Executive Secretary
“Executive Secretary” means any Executive Secretary of the Board appointed under section 14(1) and includes any person acting in that capacity;
one half of the amount of the maximum fine that is prescribed for the offence; or
$2,000.
On payment of the sum of money, no further proceedings are to be taken against that person in respect of the offence.
The Board may, with the approval of the Minister, make regulations to prescribe the offences which may be compounded.
Board
“Board” means the Productivity Fund Administration Board established under section 7;
All sums collected under this section must be paid into the Fund.
