Service of documents
(1)
The Minister may make regulations to make provision for —
the manner of service of any notice, direction, order or other document permitted or required to be given under this Act to be served on a person or a class of persons (called in this section a specified document);
the circumstances under which and time at which service of a specified document takes effect, including the following:
where the specified document was served on a person without that person’s prior written consent to being served in that way;
where a specified document is returned undelivered; and
the exceptions, modifications or adaptations to the application of any provision of or under this Act if the Commissioner is satisfied that the person to be served did not have adequate notice of the service of a specified document.
(2)
Regulations made under subsection (1) may make different provisions for —
different persons or documents;
different classes of persons or documents; or
different circumstances.
(3)
An affidavit or oral evidence of the Commissioner or an authorised officer as to the service of any notice, direction, order or other document to be served under this Act is admissible as prima facie proof of service of the document.
(4)
In this section, “document” excludes any document to be served in proceedings in court.
