Clause 2

Amendment of section 2

Subsection (1) of section 2 of the Planning Ordinance, 1959 (hereinafter in this Ordinance referred to as the “principal Ordinance”) is hereby amended by inserting immediately after the defintion of “Municipal Provident Fund” appearing therein the followin new definition: —“ “occupier” includes any person in actual occupation of land or premises or any person having the charge, management or control of the land or premises either on his own account or as the agent of another person, but shall not include a lodger;”.

Amendment of section 9

Section 9 of the principal Ordinance is hereby amended —

(a)

by deleting subsection (6) thereof;

(b)

by renumbering subsections (7), (8), (9), (10), (11), (12), (13), (14), (15) and (16) thereof as subsections (6), (7), (8), (9), (10), (11), (12), (13), (14) and (15) respectively;

(c)

by deleting the expression “subsections (5) and (6)” appearing in the first and second lines of subsection (6) thereof and substituting therefor the expression “subsection (5)”; and

(d)

by deleting the expression “, (6) or (7)” appearing in the third line of subsection (8) thereof and substituting therefor the expression “or (6)”.

Clause 4

Amendment of section 13

Section 13 of the principal Ordinance is hereby amended —

(a)

by deleting the words “person has contravened” appearing in the second line of subsection (1) thereof and substituting therefor the words “development of land has been carried out in contravention of”;

(b)

by deleting the words “such person” appearing in the fifth line of subsection (1) thereof and substituting therefor the words “the owner or occupier”; and

(c)

by deleting the word “person” appearing in the first line of subsections (2), (4) and (5) thereof and substituting therefor the words “owner or occupier”.

Clause 5

Miscellaneous amendments

The provisions of the principal Ordinance specified in the Schedule to this Ordinance are hereby amended by deleting the words “Yang di-Pertuan Negara” wherever they appear therein and substituting therefor the word “Minister”.
